SERWIZ CLOSED BETA TERMS OF SERVICE

Effective Date: April 8, 2025

By participating in this closed beta, you ("Provider," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not proceed with the onboarding process. Your participation constitutes full acceptance of the entire document.

1. Acceptance of Terms

1.1 Method of Acceptance:

Providers must indicate their acceptance by clicking "Agree" during the onboarding process.

1.2 Full Acceptance:

By proceeding with the onboarding process, you agree to all terms and provisions set forth herein.

1.3 Mandatory Agreement:

You must agree to all parts of these Terms to continue; partial acceptance is not permitted.

2. Scope of the Closed Beta Offering

2.1 Focus:

This closed beta is limited to onboarding service providers only through data collection.

2.2 Purpose of Data Collection:

The data collected will eventually be used to construct detailed provider profiles for future consumer booking. Such profiles are intended for future publication and consumer interaction.

2.3 Service Delivery:

No physical services will be delivered during the beta phase. Physical service delivery will commence only once provider profiles are built and an appropriate payment mechanism is established.

3. Onboarding Process

3.1 Process Structure:

The onboarding process is a multi-step procedure that includes:

  • Introduction & Basic Information
  • Location Preferences
  • Scheduling
  • Service Offerings
  • Booking Settings and Cancellation Policy
  • About Me / Backstory
  • Additional Questions
  • Onboarding Completion & Feedback

3.2 Objective:

The primary objective is to gather comprehensive data that will inform the construction of detailed provider profiles for future consumer interaction.

3.3 Feedback Collection:

The "Onboarding Completion & Feedback" step is designed to collect feedback for improving both the data collection process and future consumer-facing features. Participation in this step is optional and will not affect your standing in the beta.

4. Provider Obligations

4.1 Accuracy of Information:

You are required to supply accurate and verifiable information throughout the onboarding process. This data will later be editable within your service provider profile.

4.2 Self-Reported Credentials:

All information, including licenses and qualifications, is self-reported. Serwiz accepts this data without independent verification and may aggregate and anonymize it for internal development and product refinement.

4.3 Feedback:

While your feedback is valuable for platform improvement, its provision is optional and will not impact your eligibility or status in the beta.

5. Beta Disclaimer and Limitations

5.1 Experimental Nature:

The platform is provided in an experimental MVP/Beta phase. Providers should expect bugs, downtime, and evolving features during this period.

5.2 No Physical Service Delivery:

During the beta, the service is strictly limited to data collection. Physical service delivery will commence only after provider profiles and payment mechanisms are fully developed.

5.3 No Guarantee on Future Features:

There is no guarantee that the features or data collected during the beta will be implemented in the final product. Your participation is solely for the purpose of platform development and improvement.

5.4 Beta Acknowledgment and Waiver of Claims:

By accessing and using the Serwiz closed beta, you acknowledge that you are participating in an experimental test phase. To the maximum extent permitted by applicable law, you waive any claims against Serwiz arising from errors, bugs, downtime, incomplete features, or any discrepancies resulting from the beta phase. Notwithstanding the foregoing, any non-waivable statutory rights remain unaffected.

6. Liability and Disclaimers

6.1 Risk Assumption:

By participating in this beta, you acknowledge and agree that your use of the platform is entirely at your own risk. The service is provided "as is" with no warranties, express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

6.2 Limitation of Liability:

Serwiz disclaims any liability for indirect, incidental, special, consequential, or punitive damages arising from your use of the closed-beta service. Direct liability does not apply in the closed Beta.

6.3 Force Majeure:

Serwiz is not liable for any failure or delay in performance due to causes beyond its reasonable control, including natural disasters, technical failures, governmental orders, or third-party service interruptions.

7. Intellectual Property & Data Usage

7.1 Ownership and License Grant:

You retain ownership of the data you provide during the onboarding process. However, you grant Serwiz a non-exclusive, worldwide, royalty-free license to use, analyze, and aggregate your data for purposes such as:

  • Matching providers with consumers,
  • Building provider profiles,
  • Providing access to your personalized AI assistant,
  • Internal platform development, and
  • Any other natural extension of these purposes.

This license is essential for operating and improving our service.

7.2 Compliance and Confidentiality:

All identifiable information you provide will be managed in strict compliance with applicable local, provincial, and national laws, including PIPEDA and BC's Personal Information Protection Act.

7.3 Data Deletion:

If you wish to delete your profile or exercise any rights regarding your personal data, please contact us at: privacy@serwiz.ai.

7.4 Reference to Privacy Policy:

For a detailed explanation of how your personal data is collected, processed, stored, and protected, please refer to our Privacy Policy, available at: Privacy Policy. By using our service, you agree to both these Terms and our Privacy Policy.

8. Modifications to the Beta and Terms

8.1 Communication of Changes:

Any modifications or updates to these Terms or the beta functionalities will be communicated via email or in-app notifications and become effective immediately upon your next access or use of the service.

8.2 Unilateral Modifications:

By continuing to use the service, you agree that any modifications are unilaterally effective and that continued use constitutes acceptance of the updated Terms.

8.3 Effective Immediately:

No additional notice period is required; changes become effective immediately upon notification.

9. Governing Law and Dispute Resolution

9.1 Governing Law:

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada.

9.2 Binding Arbitration:

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the service shall be exclusively resolved by binding arbitration. The arbitration will be administered by [Insert Arbitration Organization or "an agreed-upon arbitration service"] in accordance with its rules, which are incorporated by reference herein.

9.3 Arbitration Process:

  • The arbitration shall take place in Vancouver, British Columbia, and will be conducted in English.
  • The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
  • By using the service, you waive your right to a trial by jury and the right to participate in any class action.

9.4 Interim Relief:

Notwithstanding the foregoing, either party may seek provisional or injunctive relief in any court of competent jurisdiction to protect its rights or property pending arbitration.

10. Final Provisions

10.1 Entire Agreement:

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Serwiz regarding your use of the service and supersede all prior communications, representations, or agreements—whether written or oral.

10.2 Severability:

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be severed, and the remaining provisions shall continue in full force and effect.

10.3 Waiver:

Failure by Serwiz to enforce any provision of these Terms at any time shall not constitute a waiver of that provision or any other provision, and such non-enforcement shall not prevent Serwiz from enforcing these Terms in the future.

11. Geographic Eligibility and Data Storage for Non-BC Providers

11.1 Intended Audience:

This closed beta is intended exclusively for service providers located within British Columbia. By signing up, you represent and warrant that you reside in, or your business primarily operates in, British Columbia.

11.2 Non-BC Providers:

If you access or use the Serwiz platform from outside British Columbia, you acknowledge and agree that you are not part of the intended beta audience. While you are welcome to join and experience the beta, by doing so you expressly waive any legal claims or rights that might otherwise be available under your local jurisdiction in relation to the platform.

11.3 Data Storage and Jurisdiction for Non-BC Providers:

Irrespective of your location, all data provided on the platform will be stored in Canada in compliance with applicable laws. By participating from outside British Columbia, you agree that your legal recourse is limited as per these Terms, and you are accepting the beta service on an "as is" basis with the limitations expressly stated herein.

12. SMS Registration‑Completion Verification Program

12.1 Program Name:

Serwiz Registration‑Completion Verification

12.2 Program Description:

One‑time passcode (OTP) text messages are sent solely to verify your phone number when you complete registration on Serwiz. No marketing or recurring texts are sent from this short code.

12.3 Message Frequency:

1 message per registration‑completion attempt.

12.4 Fees:

Message & data rates may apply, depending on your carrier plan.

12.5 Opt‑out / Help:

STOP at any time to cancel future OTP messages for registration completion. Reply HELP for assistance.
