Serwiz Terms of Service (ToS)

1. Who We Are and Scope

Serwiz ("we", "our", "us") provides a technology-driven platform that connects service providers ("Providers") with end users ("Customers") in North America.

Geographic Scope and Applicable Law:
  • Serwiz is designed for individuals residing in, working in, or visiting Canada, the United States, or Mexico.
  • If you are located outside North America, you may access and use Serwiz at your own discretion; however, please be aware that your personal information will be collected, processed, and stored exclusively under Canadian privacy laws.
  • This ToS does not extend the protections or rights granted by the data privacy laws of your home country or region (such as GDPR or similar).
  • By using Serwiz from outside North America, you acknowledge and accept these terms, and agree that your rights regarding your personal data are limited to those provided under Canadian law.

2. Beta Program Notice

The current version of the Serwiz platform is offered as a beta release for testing and evaluation purposes only. By accessing or using Serwiz during the beta period, you acknowledge and agree that:

  • The platform and its features are under active development and may be changed, improved, added, removed, or discontinued at any time without prior notice.
  • The Services may experience bugs, downtime, incomplete functionality, unexpected behavior, or data loss.
  • Serwiz does not guarantee the stability, security, accuracy, or continued availability of any features, data, or user content during the beta period.
  • Your data and activity may be monitored and used for the purpose of improving the platform and user experience. You may also be contacted for feedback regarding your beta experience.
  • Your use of Serwiz during the beta is entirely at your own risk.
  • Serwiz recommends you maintain backup copies of any important content you upload during the beta period.
  • If you do not agree to these terms, please discontinue use of Serwiz until general availability.

3. Public Platform Notice

Serwiz is an inherently public-facing platform. All provider profiles, portfolios, service offerings, and reviews are public by default and intended to be visible to anyone, including non-registered users, search engines, and third parties.

By using Serwiz, you acknowledge and accept that any information, content, or materials you upload or submit for your profile, portfolio, or reviews—including your name, biography, service details, past projects, and feedback—will be publicly accessible.

  • Do not upload any content you do not wish to make public.
  • Serwiz is not responsible for third-party use, indexing, or republication of your public information.

4. Platform Role and Liability

4.1 Intermediary Nature

Serwiz functions solely as an intermediary platform. We facilitate connections between Customers and Providers but do not supervise, endorse, or guarantee the quality, legality, or delivery of services. Assessing the suitability of Providers, Collaborators, and service suitability is solely the responsibility of Customers.

4.2 No Endorsement or Guarantee

Unless explicitly stated, Serwiz does not independently verify credentials, licenses, certifications, or the identity of Providers or Collaborators. Any "verification" or "badge" is informational only. We disclaim all liability arising from reliance on such representations.

4.3 Limitation of Liability

To the maximum extent permitted by law, Serwiz's liability for any claims arising from or relating to the use of the platform or its features—including, but not limited to, collaborator listings, credential uploads, onboarding feedback, public profile sharing, or review systems—is limited to the total fees paid by the Customer or Provider in the 12 months preceding the claim. The inclusion of such features does not constitute a guarantee or endorsement by Serwiz.

5. User Responsibilities

5.1 Accurate Information

You must provide and maintain truthful, current, and complete information in all required fields, including, but not limited to, your name, contact details, location, biography, service areas, credentials, and payment details. Submission of false, misleading, or outdated information is grounds for suspension or termination.

5.2 Prohibited Conduct

You agree not to:

  • Violate any applicable laws or regulations.
  • Engage in abusive, fraudulent, or deceptive conduct.
  • Circumvent platform booking or payment processes.
  • Exploit, misuse, or attempt to hack, reverse-engineer, or compromise any aspect of the platform.

5.3 Account Security

You are responsible for safeguarding your account credentials and for all activities conducted through your account. Immediately report any unauthorized access to Serwiz.

6. Provider Obligations

6.1 Licensing and Compliance

Providers offering regulated or licensed services must possess and maintain all valid certifications and licenses required by law in their operating jurisdiction(s). Providers are solely responsible for the accuracy and currency of profile, service, and credential information.

6.2 Service Delivery

Providers must deliver services as advertised, in accordance with their booking rules, policies, and applicable legal and ethical standards.

6.3 Indemnification

Providers agree to indemnify and hold Serwiz harmless from any claims, damages, or liabilities arising from their actions, omissions, legal violations, or service disputes.

6.4 Collaborators — Consent and Representation

Explicit Consent Required: By listing any individual as a collaborator or team member on your profile, you represent and warrant that you have obtained their express, informed, and written consent to display their name, likeness, and contact details (if provided) on the Serwiz platform and in any public or external promotional materials.

Collaborator Rights: Collaborators may request removal of their information at any time by contacting Serwiz support. Providers are responsible for maintaining up-to-date and accurate collaborator information and for responding promptly to collaborator requests.

7. Onboarding, Data, and Feedback

7.1 Data Collection and Use

Serwiz may collect onboarding and profile data to facilitate your use of the platform. By providing this data, you grant Serwiz a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and promote this information for platform and operational purposes.

7.2 Onboarding Feedback

Feedback collected during onboarding or setup may be used solely to improve the user experience, troubleshoot issues, or refine platform features. Serwiz will not use onboarding feedback as the sole basis for eligibility or visibility decisions unless otherwise disclosed and subject to an appeals process.

7.3 Licenses and Certifications

Upload and Display: Providers may upload licenses and certifications to demonstrate qualifications.

Verification Disclaimer: Unless expressly stated, Serwiz does not independently verify the authenticity or current validity of licenses or certifications. Any "verification" status or badge is informational only.

Provider Responsibility: Providers remain fully responsible for ensuring their uploaded credentials are accurate, current, and legally compliant.

8. Booking, Scheduling, and Payment

8.1 Booking Protocol

All bookings must be conducted via the Serwiz platform. Providers must clearly state their booking, cancellation, lead-time, and refund policies within their profiles.

8.2 Scheduling and Availability

Providers are responsible for maintaining up-to-date availability and honoring confirmed bookings.

8.3 Payment and Verification

Payments are processed via secure third-party providers. Serwiz does not hold, store, or control funds directly and is not liable for errors or disputes arising from third-party payment processors.

9. Portfolio, Public Profile, and External Sharing

9.1 Public Profile and Portfolio

By uploading portfolio content or enabling public profile sharing, you grant Serwiz a non-exclusive, royalty-free, worldwide license to display, reproduce, and promote your content on the Serwiz platform.

9.2 External Sharing and Promotion

Opt-In Required: Providers may opt in to external sharing of their public profile, portfolio, or service offerings through partner channels or for promotional purposes. You may update your opt-in preferences at any time in profile settings.

Scope of Sharing: By opting in, you authorize Serwiz to use your public profile content, portfolio, and service details for external marketing and syndication.

Opt-Out: Providers may revoke consent for external sharing at any time, and Serwiz will cease further external promotion within a reasonable period.

10. Reviews and Ratings

10.1 Honest Reviews

Customers may submit reviews and ratings based on their genuine experiences. Reviews must comply with platform guidelines and content policies.

10.2 Provider Rebuttal

Providers may respond to reviews, but may not offer incentives or exert pressure for users to alter or remove reviews.

10.3 Reviews on Past Projects

Eligibility: Reviews for past projects not booked via Serwiz must accurately reflect a bona fide professional relationship.

Fraud & Abuse: It is prohibited to solicit, submit, or accept reviews for projects that did not occur, are fabricated, or materially misrepresent the nature of the work performed.

Moderation: Serwiz reserves the right to moderate, remove, or investigate any review that is suspected to be fraudulent, misleading, defamatory, or otherwise violates platform guidelines.

Review Process: Moderation will be conducted promptly; users and providers will be notified of review takedowns and may appeal moderation decisions by contacting Serwiz support.

11. Restricted Activities

11.1 Prohibited Services

Providers may not offer services that are illegal, unsafe, unethical, or in violation of applicable law.

11.2 Content Restrictions

Users may not publish or submit content that is defamatory, obscene, deceptive, or infringes intellectual property or other protected rights.

12. Account Termination and Appeals

12.1 Termination by Serwiz

Serwiz may suspend or terminate any account for violations of these Terms, breach of applicable law, or conduct detrimental to the platform or its users.

12.2 Termination by User

Users may terminate their account and agreement at any time by ceasing use of the platform and deleting their account via profile settings or by contacting Serwiz support.

12.3 Appeals Process

All suspensions or terminations are subject to appeal. Appeals may be submitted via support and will be evaluated case-by-case.

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the Province of British Columbia and applicable Canadian federal laws. If operating outside of Canada, jurisdiction may be subject to local laws and regulations.

13.2 Mediation and Arbitration

All disputes will first be addressed through mediation. If unresolved, disputes may proceed to binding arbitration in British Columbia (or relevant local jurisdiction if outside Canada).

14. Amendments and Notifications

14.1 Right to Update

Serwiz reserves the right to amend these Terms to address evolving operational or legal requirements.

Material changes may be communicated via email or platform notification.

14.2 Acceptance

Continued use of the platform after notification of updated Terms constitutes acceptance of the revised Terms.

15. Miscellaneous Provisions

15.1 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remainder will continue in effect.

15.2 Entire Agreement

These Terms constitute the entire agreement between you and Serwiz, superseding all prior agreements and understandings.
