Serwiz Beta Privacy Policy (Canada)

Welcome to the Serwiz closed beta. This document ("Privacy Policy") explains how Serwiz ("we," "our," or "us") collects, uses, discloses, and protects your personal information while you participate in our beta testing program. We are committed to handling your data in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and British Columbia's Personal Information Protection Act (PIPA), as well as other applicable Canadian privacy laws.

By participating in the Serwiz beta and accessing our platform (the "Services"), you agree to the practices described below. If you disagree with any part of this Privacy Policy, please discontinue use of the beta.

1. Scope & Applicability

Closed Beta Coverage

This Privacy Policy applies to individuals who have been invited to, or have otherwise joined, our closed beta test. It is designed for compliance with PIPEDA and BC PIPA, and does not extend to other countries' privacy laws (e.g., GDPR) unless explicitly stated.

Non-Canadian Users

If you live outside Canada and choose to participate, please be aware that Serwiz processes and stores your data exclusively in Canada. Our legal obligations are defined by Canadian law.

Beta Context

Because this is a beta test, features, data-collection mechanisms, and processing flows may change. We describe these evolving conditions further in Section 7 ("Beta Clause").

2. Information We Collect

We collect only the basic account data ("Personal Information") needed to operate our beta and refine the Services:

  • Contact Information: Name, email address, phone number
  • Interaction Data: Login timestamps, navigation within the platform, usage patterns
  • Technical Data: IP address, device identifiers, browser type, and crash logs

We do not knowingly collect sensitive data (e.g., health records, data on minors). If you believe we have inadvertently collected such data, contact us at privacy@serwiz.ai so we can delete it.

2.1 Cookies & Similar Technologies

We may use cookies (small text files stored on your device) and similar tracking methods to:

  • Maintain Session State: Keep you logged in securely and remember your preferences during visits.
  • Analyze Beta Performance: Gather usage data (e.g., page views, click interactions) to locate bugs, measure performance, and improve the user experience.
  • Track Crashes & Errors: Capture diagnostic logs that help us identify and fix errors efficiently.

2.1.1 No In-Platform Cookie Opt-Out

During this closed beta, we do not provide a separate in-platform cookie opt-out because these cookies are essential to core beta functionality. Disabling them would make the beta inoperable or severely limit its features. Your participation implies consent to our essential cookie usage.

2.1.2 Browser-Level Controls

You can refuse or remove cookies by adjusting your browser settings. However, if you block cookies, you will not be able to fully participate in the beta or utilize certain features. By continuing to use the beta, you acknowledge that these cookies are essential for testing and agree to their use.

2.1.3 Future Enhancements

As Serwiz evolves beyond the closed beta, we anticipate adding more granular cookie-preference tools. For now, we rely on minimal, essential cookies to facilitate beta testing.

2.2 SMS Registration‑Completion Data

When you complete registration, Serwiz sends a one‑time passcode (OTP) to the phone number you provide. We store that number and delivery logs solely to verify your identity, guard against fraud, and comply with carrier requirements. We do not use these numbers for marketing or recurring messages. You may opt out at any time by replying STOP.

Delivery and opt‑out processing are handled by our SMS provider (AWS End User Messaging). Logs are retained for the minimum period required for security and audit purposes, after which they are deleted or anonymised.

3. Purpose & Use of Personal Information

We use your personal information to:

Manage Beta Participation

Verify and administer your beta account.

Provide & Enhance Services

Monitor performance, debug issues, and iterate on platform features.

Recommendations & Analytics

Generate usage metrics, gain insights into feature adoption, and deliver basic personalized recommendations.

AI Model Training

Use anonymized and aggregated data to improve AI-driven functionalities. We ensure that de-identified data cannot be re-linked to individual users.

Under no circumstance do we sell personal information.

4. Data Disclosure Practices

Service-Related Sharing

We may share limited personal information with third-party service providers (e.g., cloud hosting, customer support, payment processors if relevant) to run and support the beta.

These partners must comply with PIPEDA, BC PIPA, and strict confidentiality obligations.

Analytics & Bug Reporting

We may integrate external analytics or error-reporting tools that store or process certain data outside Canada (e.g., log data). Where possible, data is anonymized or pseudonymized to reduce privacy risks.

Legal Requirements

If required by law or necessary to protect our rights, property, or user safety, we may disclose personal information to comply with lawful requests or legal processes.

5. Cross-Border Transfers

Data Residency

We primarily host and process your data at AWS Canada (Canada Central).

Possible International Processing

In some instances (e.g., using external analytics or bug-tracking services), data may be transferred to or stored in servers outside Canada. We implement appropriate safeguards (e.g., contractual protections) consistent with PIPEDA/PIPA.

Consent Mechanism

By participating in the beta, you acknowledge that limited cross-border transfers may occur. We will request explicit consent for any new cross-border scenarios that expand beyond the scope described here.

6. User Rights & Requests

Access & Correction

You have the right to request access to, or correction of, your personal data by emailing privacy@serwiz.ai.

Data Deletion (Right to Erasure)

You may request deletion of your personal data at any time. We will erase it unless legally required to retain it (e.g., for tax, audit, or security logs).

Withdrawal of Consent

You can withdraw previously granted consent (e.g., for marketing communications). Doing so may limit your ability to continue in the beta, but it does not affect processing that was lawful prior to withdrawal.

7. Beta Clause & Limited Recourse

Feature Fluidity

As a test environment, the beta's features, data-collection processes, and usage flows can change rapidly. We will inform participants of significant changes when possible.

Risk Disclosure

You acknowledge increased risks of bugs, outages, or data mishaps during an experimental beta.

Legal Rights Not Waived

This clause does not override fundamental privacy rights. You still enjoy the protections and remedies provided under PIPEDA and BC PIPA.

8. Data Retention & Disposal

Retention Timeline

We will retain your data until the official launch of Serwiz or upon your request for deletion, unless a legal obligation requires further retention.

Migration to Production

After the beta concludes, we may integrate your data into our live environment to preserve accounts, historical usage insights, and improvements gained from testing.

Secure Disposal

Once data is no longer needed, we securely delete or anonymize it per PIPEDA and BC PIPA guidelines.

9. Security Measures

Technical Protections

We protect data using encryption (TLS in transit, AES-256 at rest), firewalls, and role-based access controls.

Organizational Safeguards

Only authorized personnel can access personal data, and they are bound by non-disclosure and confidentiality requirements.

Breach Notification

Should a security breach compromise user data, we will notify you and relevant regulatory bodies in compliance with Canadian privacy requirements.

10. Children's Privacy

Our beta is designed for adults (18+) only. We do not knowingly collect data from minors. If you suspect a minor is participating, please contact us at privacy@serwiz.ai.

11. Marketing & Communications

Beta Updates

We may send you email or in-app notifications about critical system updates, new features, or scheduled maintenance relevant to the beta.

Promotional Messages

We may deliver marketing communications only if you opted in. You can unsubscribe at any time.

11.2 No Third-Party Marketing

No Sale of Personal Data: We do not sell, rent, or otherwise monetize personal information (e.g., names or contact details) to external advertisers or marketers.

No Unsolicited Promotions: We do not share your personal data with outside organizations that would send you marketing messages unrelated to Serwiz.

Approved Vendors: When we work with third-party providers (like payment processors, analytics tools), they are legally obligated to use your data strictly for the specified tasks.

Aggregated Insights: We may share aggregated, anonymized data (e.g., usage statistics) with partners for analytics or AI model training, ensuring it cannot be traced back to individual users.

Legal Alignment: This approach aligns with PIPEDA and BC PIPA by minimizing unsolicited communications and respecting user privacy choices.

12. Transparency & Amendments

Policy Updates

We may update this Privacy Policy as the beta evolves or to comply with new legal mandates.

Notice of Changes

Material changes will be communicated via email or in-app notifications. Continued participation after any update indicates acceptance of the revised policy.

Version History

We keep a record of past policy versions and will provide them upon request.

14. Acceptance of This Policy

By participating in the Serwiz beta and providing personal information, you affirm that you have read, understood, and agree to this Privacy Policy. This includes our cookie practices, our reliance on essential cookies in lieu of an in-platform opt-out, and our obligations under PIPEDA and BC PIPA.
